Read the complete decision file
Collect the decision notice, officer report, submitted drawings, consultation responses and any amendments. Leeds provides a public planning application search. Search the property history as well as the latest reference so that earlier permissions or restrictions are not overlooked.
Make a refusal response table with one row for each reason: the concern, the evidence cited, your response and any missing information. Separate disagreement over facts from disagreement over planning judgment. A disputed room dimension may need a measured correction; a concern about community imbalance needs a different kind of argument. Treating them alike can produce a lengthy statement that misses the decisive issue.
Decide what a revised scheme would achieve
Consider whether a change to occupancy, communal accommodation, access or the external layout would materially address the concerns. Write down the effect of each change rather than presenting cosmetic revisions as a new solution. If the objection relates to the principle of additional HMO use in that location, redesigning a bathroom alone may not answer it.
Compare the revised-application route with an appeal against the original proposal. The comparison should consider the evidence available, the decision you are seeking and the procedural rules for each route. Avoid assuming that an appeal is a routine second application in which a substantially different scheme can be introduced without difficulty.
Check the current appeal procedure and deadline
The Planning Inspectorate has separate procedural guidance for applications dated on or after 1 April 2026. Check the date of the underlying application and the relevant appeal category before preparing documents. Many ordinary planning refusals have a six-month appeal period, but householder and enforcement-related cases can have different deadlines.
Where enforcement action is involved, shorter time limits can apply. Use the official deadline guidance and the actual notices; do not calculate your timetable from a general website summary. Record the relevant dates immediately and obtain advice if the route or time limit is uncertain. A complete evidence file is of little use if the appeal is submitted too late.
Prepare an evidence-led planning argument
A strong appeal statement should explain the proposal, identify the issues in dispute and connect each response to evidence. For an HMO, useful project-specific material may include the measured layout, photographs of relationships with neighbouring rooms, an occupation schedule and a carefully explained assessment of local circumstances.
Present assumptions openly. If an occupancy dataset is incomplete, explain what it can and cannot show. If you rely on a nearby appeal, read the full decision and identify why the relevant circumstances are comparable. A matching postcode or the same number of bedrooms is not, by itself, a sound comparison.
Use past decisions responsibly
This page does not present unverified appeal numbers, success rates or invented Leeds case studies. A case example should only be published after the official decision has been checked, including the site, proposal, result and reasons. An inspector allowing another scheme does not guarantee the same outcome for your property.
If you already have a decision you consider helpful, provide the complete document and reference. The review should identify both the points that support your argument and the differences that weaken the comparison. That balanced approach makes the eventual advice more useful for a commercial decision.
What to send for a refusal review
Send the council reference, decision notice, application date, all submitted drawings, any enforcement correspondence and your intended next step. Explain whether you would consider a lower occupancy or revised layout. The objective is a clear recommendation on the available options, the evidence needed and the immediate deadlines, without promising an appeal result.
Your questions, answered
Is an HMO change-of-use appeal a householder appeal?
Do not assume so because the property is a house. Select the procedure using the application type and current Planning Inspectorate guidance.
Can a licensing application overturn a planning refusal?
No. The licensing process does not reverse the planning decision. Resolve the planning position through the appropriate planning route.
Can you guarantee an appeal will succeed?
No. An assessment can explain strengths, weaknesses and evidence gaps, but the inspector determines the appeal.
