At PCMA and Plandome, we value and respect intellectual property (IP) rights and aim to foster an environment that encourages the responsible and ethical use of our platform, services, and materials. This policy outlines the ownership, licensing, and usage terms for deliverables, audit reports, and planning documents produced through our services.

1. Copyright Ownership of Audit Reports

All audit reports generated using the services provided by PCMA and Plandome are considered original works protected by copyright. The copyright ownership of these reports remains with Plandome unless otherwise agreed upon in writing. Clients are granted a limited, non-exclusive, non-transferable license to use the audit reports solely for their internal purposes. Any redistribution, reproduction, or modification of the reports for external use, including but not limited to resale or sharing with third parties, is prohibited without explicit written consent from Plandome.

2. Licensing Terms for Deliverables

Deliverables, including but not limited to design concepts, property assessments, and other materials provided by Plandome, are licensed to the client for a specific use as defined in the agreement between the parties. Plandome retains all rights to the underlying intellectual property, including patents, trademarks, and copyrights. Clients are granted a non-exclusive, non-transferable license to use the deliverables in accordance with the project goals. This license does not grant the client any rights to redistribute, modify, or commercialize the deliverables without prior written consent from Plandome.

In cases where deliverables are based on proprietary methodologies or tools developed by Plandome, such methodologies remain the sole intellectual property of Plandome, and clients do not acquire any ownership rights to these tools or methodologies through the use of the deliverables.

3. Usage Restrictions for Planning Documents

Planning documents created by Plandome, including but not limited to project plans, feasibility studies, architectural designs, and development roadmaps, are protected by copyright law. These documents are provided for the exclusive use of the client and cannot be used for any other purpose without prior written consent from Plandome. This includes, but is not limited to, commercial resale, sharing with third parties, or any use that deviates from the scope of the project.

Client Responsibility: Clients are responsible for ensuring that any external parties to whom they share planning documents are made aware of these restrictions and are required to adhere to them.

4. Client vs. Plandome IP Ownership

Client IP Ownership: The client retains ownership of any materials, intellectual property, or data they provide to Plandome during the course of a project (e.g., logos, brand assets, proprietary data). However, clients acknowledge that any modifications or enhancements made by Plandome to these materials during the course of the project may remain under Plandome's ownership unless otherwise stated in a separate agreement.

Plandome IP Ownership: Any intellectual property created by Plandome during the project, including but not limited to designs, tools, reports, and methodologies, remains the sole and exclusive property of Plandome. Clients are granted limited rights to use these IP assets as outlined in the agreement, but ownership rights do not transfer.

In cases where the client requires full ownership of any deliverables, a separate licensing or transfer agreement must be negotiated.

5. General Terms

Fair Use and Restrictions: Clients and users are prohibited from using any materials provided by Plandome in a manner that infringes upon Plandome's intellectual property rights. This includes unauthorized duplication, distribution, or modification of any report, document, or design.

Transfer of Rights: Any transfer of ownership or licensing of intellectual property must be formalized in writing. Without a signed agreement, no rights are transferred.

6. Enforcement and Compliance

We take the protection of intellectual property seriously. Unauthorized use of materials provided by Plandome will result in the suspension of access to our services and potential legal action. Clients are required to report any suspected infringements of this policy promptly.
